SECTION 1 – WHAT WE COLLECT & WHY

When you register on our site, provide us online feedback on our products or services, subscribe to a newsletter, fill out a form, or purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, mailing address, email address, phone number, credit card information or other details to help you with your experience.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

We may use the information we collect from you in the following ways:

  • Follow up with you after correspondence. (live chat, email or phone inquiries)
  • Better service you in responding to your customer service requests.

How do you get my consent?

CAN-SPAM Act:

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions.
  • Process orders and to send information and updates pertaining to orders.
  • Send you additional information related to your product and/or service.
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

To be in accordance with CAN-SPAM, we agree to the following:

  • Not to use false or misleading subjects or email addresses.
  • Identify the message as an advertisement in some reasonable way.
  • Include the physical address of our business or site headquarters.
  • Monitor third-party email marketing services for compliance, if one is used.
  • Honor opt-out/unsubscribe requests quickly.
  • Allow users to unsubscribe by using the link at the bottom of each email.

SECTION 3 – DISCLOSURE

We do not sell, trade, or otherwise transfer to outside parties your Personally Identifiable Information other than details collected to facilitate payment transactions to our payment processor. We also disclose your name and mailing address to our shipping partners to facilitate delivery of your order to you.

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

SECTION 4 – DATA PROTECTION & SECURITY

Our website is scanned on a regular basis for malware, security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology.

We implement a variety of security measures when a user places an order enters, submits, or accesses their information to maintain the safety of your personal information.

All transactions are encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Fair Information Practices:

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

  • We will notify you via email within 7 business days
  • We will notify the users via in-site notification within 7 business days

We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or government agencies to investigate and/or prosecute non-compliance by data processors.

SECTION 5 – THIRD-PARTY SERVICES

We do not include or offer third-party products or services on our website.

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. SECTION 6 – COOKIES

For instance, we use cookies to help us remember and process the items in your shopping cart. Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising Initiative Opt Out page or by using the Google Analytics Opt Out Browser add on.

We honor Do Not Track signals and do not track, plant cookies, or use advertising when a Do Not Track (DNT) browser mechanism is in place.

We’ve listed the cookies that we use here so you can choose if you want to opt-out of cookies or not.

To keep track of shopping cart data, we makes use of 4 cookies:

  • woocommerce_recently_viewed
  • woocommerce_cart_{HASH}
  • woocommerce_items_in_cart
  • wp_woocommerce_session_{HASH}

The first three cookies contain information about the cart as a whole and helps us know when the cart data changes and all expire at the end of the browsing session. The final cookie (wp_woocommerce_session_) contains a unique code for each customer so that our system knows where to find the cart data in the database for each customer and expires after 48 hours. No personal information is stored within these cookies.

When visitors comment on our blog, they too get cookies stored on their computer. This is purely a convenience, so that the visitor won’t need to re-type all their information again when they want to leave another comment. Three cookies are set for commenters:

  • comment_author_email_{HASH}
  • comment_author_url_{HASH}

The comment cookies are set to expire a little under one year from the time they’re set.

SECTION 7 – CALIFORNIA ONLINE PRIVACY PROTECTION ACT

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. According to CalOPPA, we agree to the following:

  • Users can visit our site anonymously.
  • Once this privacy policy is created, we will add a link to it on our home page or as a minimum, on the first significant page after entering our website.
  • Our Privacy Policy link includes the word ‘Privacy’ and can easily be found on the page specified above.

SECTION 8 – AGE OF CONSENT

COPPA (Children Online Privacy Protection Act)

When it comes to the collection of personal information from children under the age of 13 years old, the Children’s Online Privacy Protection Act (COPPA) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online.

While we do sell young children’s clothing and other items, we do not specifically market to children under the age of 13 years old.

By using this site, you represent that you are at least the age of majority in your state or province of residence.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
